GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. Purpose and scope

1.1. These General Terms and Conditions of Sale (hereinafter "GTC") apply to all sales of products made by MURIELLE PERROTTI CREATIONS (hereinafter "MP CREATIONS") to the customer (hereinafter "the Customer") via its online sales sites or directly, both to consumers (hereinafter "B2C Customers") and to professional resellers (hereinafter "B2B Customers").

1.2. In the event that any clause of these GTC is found to be null or invalid for any reason, this nullity or invalidity shall not result in the nullity or invalidity of the other clauses, which shall continue to apply. Similarly, in the event of a discrepancy between different translations of the GTC, the French version shall prevail.

1.3. MP CREATIONS reserves the right to modify the GTC at any time. The applicable version is the one in effect on the Site at the time of the order.

2. Account creation and access to the site

2.1. In order to place an order, the Customer must first register on the online sales Site (hereinafter "the Site") by creating an account that includes their information.

2.2. In case of an error in the delivery address, MP CREATIONS cannot be held responsible for any delivery issues that may arise.

2.3. By registering on the Site, the Client declares and guarantees to MP CREATIONS that they are of legal age and have the legal capacity to contract.

2.4. MP CREATIONS may delete a Client account at its sole discretion in the event of non-compliance with the General Terms and Conditions, fraud, abnormal use of the site, or for any other legitimate reasons.

2.5. The Client acknowledges assuming all risks related to any content downloaded or obtained in any other way through the use of the site and agrees that they are solely responsible for any damage caused to their computer system or any loss of data resulting from the downloading of this content.

3. Products

3.1. The products offered for sale are those described on the Site at the time of the order, within the limits of available stock or components.

3.2. The jewelry is made to order, but does not constitute personalized products in the legal sense, unless explicitly stated otherwise.

3.3. MP CREATIONS strives to present and describe the products with the utmost accuracy. However, errors may appear on the Site, which the Client acknowledges and accepts.

3.4. In the event of temporary or permanent unavailability of certain ordered products, MP CREATIONS will inform the Client who may either cancel their order and obtain a refund, or choose to replace the product with another. No other compensation may be claimed.

4. Orders

4.1. The validation of the order constitutes confirmation of the Client's acceptance of the General Terms and Conditions, the purchased products, their price, and the associated fees.

4.2. MP CREATIONS shall not be held responsible towards the Client or a third party for the harmful consequences of the withdrawal of a product from the site, the replacement or modification of any content or information on this site, or the refusal or cancellation of an order in the event of a prior dispute, suspicion of fraud, or unavailability of a product or component, even after the sending of the order confirmation or its payment.

4.3. MP CREATIONS reserves the right to refuse or cancel an order from a Client with whom it has been in dispute during a previous order or in the event of objective suspicion of fraud.

5. Prices, taxes, and payment

5.1. The prices of products on the Site are displayed including VAT for B2C Clients, and excluding VAT for B2B Clients.

5.2. MP CREATIONS may modify its prices at any time, but products are billed based on the rate in effect on the Site at the time of the order.

5.3. Payment is due in full at the time of the order, for all Clients, both individuals and professionals.

5.4. Payments are made:

  • via the secure online payment platform of the site, or
  • by bank transfer to the account of MP CREATIONS specified on the Site.

5.5. No order will be manufactured or shipped without prior receipt of full payment.

6. Delivery

6.1. Deliveries are made under the Incoterm (2010) "Ex Works" (EXW).

6.2. Unless otherwise agreed, MP CREATIONS is responsible for shipping through postal services or partner carriers. Delivery charges are then added to the invoice. The indicative price of delivery charges is indicated on the Site in the "Delivery & Returns" section.

6.3. When MP CREATIONS is responsible for delivery, the risk of loss or damage to the product is transferred to the Client at the time of delivery. By exception, the risk is transferred to the Client when the product is handed over to the carrier when the carrier is arranged by the Client and not by MP CREATIONS.

6.5. The average delivery time for an order is approximately ten (10) working days for delivery in Belgium and twelve (12) working days for the rest of Europe. The day after the launch of a collection and from December 1 to December 31, the delivery time may be extended by ten (10) days, given the significant and exceptional volume of orders. These times are indicative.

6.6. In the event of exceeding the agreed deadline by more than ten (10) days, the Client may request the cancellation of the sale and obtain, within a maximum period of forty (40) days from their request, a refund of the amounts paid for the order. Notwithstanding the above, MP CREATIONS cannot be held responsible for any damages resulting from a delay in delivery, with only the refund of the product by MP CREATIONS being possible, excluding any other form of compensation.

6.7. In case of an incorrect address or failure to collect or receive by the Client, the reshipment will be charged to the Client.

7. Receipt and complaints

7.1. The Client must check the condition of the package. In case of damage to the package, they must inform the carrier and refuse the package by returning it to MP CREATIONS.

7.2. In general, any complaint regarding the quality, quantity, or apparent conformity of the received products must be made in writing via the contact form on the Site, within a strict timeframe of 48 hours following receipt. After this period, the delivery is deemed compliant and no claims related to apparent defects will be accepted.

8. Right of withdrawal, exchange, and returns

8.1. In accordance with European law, the consumer (B2C Client) has a period of 14 days from delivery to exercise their right of withdrawal. This right does not apply to professional resellers (B2B Client).

8.2. An exchange for another product of the brand is possible if the purchase was made as a gift (B2C Client).

8.2. Customized products (if applicable) are excluded from the right of withdrawal or exchange.

8.3. Return or exchange procedure:

  • Notify MP CREATIONS of the return or exchange request via the contact form on the Site.
  • Return the product in a padded envelope with a barcode and a copy of the request, in its new, unworn, undamaged condition, in its original packaging. MP CREATIONS may refuse a non-compliant return.
  • After verifying the compliance of the product, the refund (of the net value purchased possibly deducted from transaction fees) will occur within a maximum of 30 days after receipt and verification of the product.

8.4. Return costs and risks are the responsibility of the Customer. The responsibility for the loss or potential damage to the package during the return cannot be attributed to MP CREATIONS.

9. Warranty

9.1. A 1-year compliance warranty covers manufacturing or assembly defects.

9.2. The warranty does not apply to damages related to shocks, misuse, or normal wear and tear of the product as well as to use not in accordance with our recommendations.

9.3. The request must be made before the end of the warranty period, with a photo and proof of purchase, either via the contact form on the Site or at the store where the product was purchased.

10. Repairs

10.1. Under warranty: return costs are borne by the Customer. MP CREATIONS covers labor and shipping costs. The replacement of missing parts is the responsibility of the Customer.

10.2. Out of warranty: before repair, a quote is provided by MP CREATIONS. The Customer bears the return costs, labor, shipping costs, and the replacement of parts.

11. Retention of title

MP CREATIONS retains ownership of the products until full payment of the price, including costs.

The transfer of risks occurs according to article 6.3.

12. Limitation of liability

12.1. The (extra) contractual liability of MP CREATIONS is limited to the replacement of the defective or missing product or to the refund of the price of said product. Claims do not release the Customer from their obligation to pay the full price of the delivered goods.

12.2. The liability of MP CREATIONS is limited to defects appearing on the product within a period of 6 months from the date of sale. In any case, the liability of MP CREATIONS will only cover 'normal' use of the product and will not cover defects arising from the use of aggressive products (such as chlorine, corrosive cleaning products, body creams, perfumes, etc.) for which MP CREATIONS cannot guarantee the durability of the plating ( 'abusive' use). The 'normal' or 'abusive' use of the product will be assessed by MP CREATIONS based on the information provided and the analysis of the defective product.

12.3. Under no circumstances can MP CREATIONS be held liable:

  • for indirect, immaterial or consequential damages,
  • for delays attributable to the carrier or a case of force majeure,
  • for the temporary inability to manufacture due to unavailability of components.
13. Force majeure

13.1. The following are considered cases of force majeure: strikes, natural disasters, supplier breakdowns, supply chain disruptions, logistical disturbances, pandemics, government decisions, etc.

13.2. In the event of force majeure preventing delivery, MP CREATIONS may cancel the order and refund the payments made. No other compensation may be claimed.

14. Intellectual property

The creations, photos, texts, and designs present on the Site remain the exclusive property of MP CREATIONS. Any reproduction or unauthorized use is prohibited.

15. Personal data

The processing of personal data is described in the Privacy Policy available on the Site.

16. Applicable law and jurisdiction

16.1. These General Terms and Conditions are subject to Belgian law in accordance with European Directives.

16.2. This applies to both substantive law rules and procedural rules. In the event of a dispute, MP CREATIONS will prefer a settlement out of court (amicable agreement). This search for an amicable agreement will not suspend the time limit for taking action under warranties.

16.3. If an amicable agreement cannot be reached, the Belgian courts (Liège jurisdiction) will have sole competence, subject to any public order provision stating otherwise.
